If stem cell-based therapies are developed, we will likely confront a difficult problem of justice: for biological reasons alone, the new therapies might benefit only a limited range of patients. In fact, they might benefit primarily white Americans, thereby exacerbating long-standing differences in health and health care.

The modernist and scientific juxtaposition of object and subject are inappropriate when investigating the nature of “knowledge.” This commentary argues that the usual methodological dichotomy fails when it is applied to the domain of “knowledge.” The two instead coalesce within the topic itself, demanding the most careful self-awareness.

The interface between mental health services and the criminal justice system presents challenges both for professionals and patients. Both systems are stressed and inherently complex. Section 136 of the Mental Health Act is unusual being both an aspect of the Mental Health Act and a power of arrest. It has a long and controversial history related to concerns about who has been detained and how the section was applied. More recently, Section 136 has had a public profile stemming from the (...) use of police cells as places of safety for young, mentally disturbed individuals. This paper explores the current state of health of this piece of legislation. Specifically, we consider whether alternative approaches are more suitable for those individuals in crisis and/or distress who come into contact with the police. This requires careful thought as to the proper role of both health and criminal justice professionals who are daily grappling with an ethically contentious domain of multiagency work. (shrink)

Macmurray provides a conceptual and personal reference point around which we can locate a tradition of social humanism that unfolds from the British idealists to the communitarians. Some communitarian themes appear in the thought of the idealists: these include a vitalist analysis of behaviour, a 'thick' view of the person, and a positive concept of freedom defined in relation to others. Macmurray developed these themes and introduced others largely as a result of reworking idealism so as to come to terms (...) with the crisis of reason associated with the First World War. He rejected objective idealism with its concept of absolute mind for a personal idealism that incorporated an action-based metaphysics. Doing so prompted him to adopt other communitarian themes: these include an appeal to friendship and love, a contrast between society and community, and an appeal to religion to transcend the limits of justice. While contemporary communitarians have inherited much from philosophers such as Macmurray, they have also developed the tradition of social humanism. Philosophers such as Sandel, Taylor and Walzer have done so through grappling with the implications of multiculturalism for the idea of a cosmopolitan community. Ethical socialists like Tony Blair and Raymond Plant have done so through grappling with issues such as a decline in solidarity as it influences the welfare state. (shrink)

We report on the deliberations of an interdisciplinary group of experts in science, law, and philosophy who convened to discuss novel ethical and policy challenges in stem cell research. In this report we discuss the ethical and policy implications of safety concerns in the transition from basic laboratory research to clinical applications of cell-based therapies derived from stem cells. Although many features of this transition from lab to clinic are common to other therapies, three aspects of stem cell biology pose (...) unique challenges. First, tension regarding the use of human embryos may complicate the scientific development of safe and effective cell lines. Second, because human stem cells were not developed in the laboratory until 1998, few safety questions relating to human applications have been addressed in animal research. Third, preclinical and clinical testing of biologic agents, particularly those as inherently complex as mammalian cells, present formidable challenges, such as the need to develop suitable standardized assays and the difficulty of selecting appropriate patient populations for early phase trials. We recommend that scientists, policy makers, and the public discuss these issues responsibly, and further, that a national advisory committee to oversee human trials of cell therapies be established. **NB we did not reccommend a NAC, we think it might be appropriate**. Substantial medical evidence shows that about half of ovarian cancers originate in the fallopian tube. Some medical organizations and clinical articles have suggested opportunistic salpingectomy to reduce the risk of ovarian cancer in patients at average risk of developing it. This entails removing the fallopian tubes at the same time as another procedure that would occur anyway. The authors argue that the principles of totality and double effect can justify such salpingectomies, even though there is a low incidence of ovarian (...) cancer. Since screening tools for ovarian cancer are ineffective and treatment options are poor, the good effect of reducing the risk of death from this type of ovarian cancer can be proportionate to the bad effects of the minor increase in surgical risk over the other procedure, the unintended side effect of infertility, and the removal of normally functioning tissue. The authors conclude that it is within the purview of a patient and physician to determine whether the benefits are proportionate to the risks in a particular case. (shrink)

In the study reported here we examined the impact of population size and two proxies of risk of resource failure on the diversity and complexity of the food-getting toolkits of hunter–gatherers and small-scale food producers. We tested three hypotheses: the risk hypothesis, the population-size hypothesis, and a hypothesis derived from niche construction theory. Our analyses indicated that the toolkits of hunter–gatherers are more affected by risk than are the toolkits of food producers. They also showed that the toolkits of food (...) producers are more affected by population size than are the toolkits of hunter–gatherers. This pattern is inconsistent with the predictions of both the risk hypothesis and the population-size hypothesis. In contrast, it is consistent with the predictions of the niche construction hypothesis. Our results indicate that niche construction has affected the evolution of technology in small-scale societies and imply that niche construction must be taken into account when seeking to understand technological variation among food producers and the technological changes that occurred in association with the various transitions to farming that have occurred over the last 10,000 years. The text of Theaetetus 155b1-2 as recorded in the manuscripts and printed in current editions of the dialogue is marked by a syntactical anomaly (ἀλλά postpositum) and a logical non sequitur (arbitrary transition from a copulative to an existential use of εἷναι and vice versa). Attempts at emendation by Proclus, Stephanus and Campbell have all been unsuccessful. To find the way back to Plato's original text, the reader will have to fight his way through a logical tangle (the result of (...) a double negation) and abandon the modish, but erroneous, belief that there is no difference in ancient Greek between ``complete'' and ``incomplete'' uses of εἷναι. The modern editorial practice of printing Old English poetry one verse to a line with a distinct separation between half-lines distracts attention from a well-known and important fact, that Old English poetry is copied without exception in long lines across the writing space. Normal scribal practice does not distinguish verses, reserving capitals and points for major divisions of a work. In manuscripts of Latin poetry, however, quite another practice holds. Latin verses copied in England after the eighth century are regularly (...) transmitted in a format familiar to modern readers: verses are set out one to a line of writing, capitals begin each line, and often some sort of pointing marks the end of each verse. The regularity of this distinction in copying practice and the difference in the nature and level of the graphic conventions used for verse in the two languages imply that such scribal practice was deliberate and was useful and significant for contemporary readers. From the early 1970s Conor Cruise O'Brien acquired a reputation in Ireland and internationally as one of the most vociferous critics of nationalism. While many see the origins of his critique in his reaction to the emergence of militant nationalism in Northern Ireland at this time, in this article I argue that the foundations of O'Brien's anti-nationalism had already been laid in the postwar European context. The article illustrates how O'Brien's historical and intellectual experience in the aftermath (...) of the Second World War had an essentially conservative influence on his thought, providing him with a pool of ideas which he would later employ in his attack on nationalism, and Irish nationalism in particular. I therefore maintain that there is a lot more continuity in O'Brien's thought than is sometimes assumed. (shrink)

This paper reports on-going work in the eSCAPE Project (Esprit Long Term Research Project 25377) directed to the research and development of electronic landscapes for public use. Our concern here is to elucidate a sociologically informed approach towards the design of electronic landscapes or virtual worlds. We suggest — and demonstrate through ethnographic studies of virtual technologies at a multimedia art museum and information technology trade show — that members sense of space is produced through social practices tied to the (...) accomplishment of activities occurring within the locations their actions are situated. Space, in other words, is socially constructed and shaped through members’ practices for accomplishing situated activities. We explicate, by practical examples, an approach to discovering social practices in and through which a sense of space is constructed and outline how such understandings may be used to formulate requirements for the design of electronic landscapes. In explicating our ethnographically informed approach, we outline how future technologies may bedeveloped through the situated evaluation of experimental prototypes in public use. (shrink)

This paper considers the political manipulation of language in the UK governmental fairness agenda. It employs Marcuse’s analytical notion of the suppression of the transitive meaning of “the word” within “the sentence.” Further to this it links the operationalizing of language with positivist and uncritical policy epistemologies used by the UK coalition government. Using this theoretical framework the paper draws out the two broad meanings of the term “fairness” used to legitimate public-sector cuts on the one hand, and by researchers (...) concerned with issues of structural inequality on the other. The 2015 Paris Agreement set a global warming limit of 2°C above preindustrial levels. Corporations play an important role in achieving this objective, and methods have recently been developed to map global climate targets to specific industries, and individual corporations within those industries. In this article, we assess whether Sustainability ratings capture corporate performance in meeting the 2°C target. We analyze nine rating schemes used by investors and three commonly used in academic studies. Most rating schemes do consider corporate greenhouse (...) gas emissions in their analysis, whereas only a minority scale emissions by factors that have the potential to allow benchmarking against science-based targets. None take the final step of mapping climate indicators against the 2°C target. Furthermore, we find a lack of consistency in the climate change ratings of the databases used in academic studies. These results are concerning in the context of being able to meet global climate change goals. (shrink)

Information is the fourth core element of public health legal preparedness and of legal preparedness for public health emergencies specifically. Clearly, the creation, transmittal, and application of information are vital to all public health endeavors. The critical significance of information grows exponentially as the complexity and scale of public threats increase.Only a small body of organized information on public health law existed before the 21st century: a series of landmark books published beginning in 1926 by Tobey, Grad, and Wing ; (...) model public health laws published as early as 1907; systematic reviews of original research studies published in the 1990s; and a small but growing number of articles published in public health journals and law reviews.With the new century came new public health law programs and activities at the Centers for Disease Control and Prevention, in public health professional associations, and in numerous non-profit and academic organizations. How is it that we think and refer in the first-person way? For most philosophers in the analytic tradition, the problem is essentially this: how two apparently conflicting kinds of properties can be reconciled and united as properties of the same entity. What is special about the first person has to be reconciled with what is ordinary about it. The range of responses reduces to four basic options. Lucy O'Brien argues that a satisfactory account of first-person reference and self-knowledge needs to concentrate on our nature as agents. Clearly written, with rigorous discussion of rival views, this book will be of interest to anyone working in the philosophy of mind and action.

Theory of mind competence and knowledge of emotions were studied longitudinally in a sample of preschoolers aged 3 (n=263) and 4 (n=244) years. Children were assessed using standard measures of theory of mind and emotion knowledge. Three competing hypotheses were tested regarding the developmental associations between children's theory of mind abilities and their knowledge of emotions. First, that an understanding of emotion develops early and informs children's understanding of others’ thinking. Alternatively, having a basic theory of mind may help children (...) learn about emotions. Third, that the two domains are separate aspects of children's social cognitive skills such that each area develops independently. Results of hierarchical regressions supported the first hypothesis that early emotion understanding predicts later theory-of-mind performance, and not the reverse. (shrink)

Prompted by the development of the Theory of Challenge and Threat States in Athletes (Jones et al, 2009), recent years has witnessed a considerable increase in research examining challenge and threat in sport. This manuscript provides a critical review of the literature examining challenge and threat in sport, tracing its historical development and some of the current empirical ambiguities. In an attempt to reconcile some of these ambiguities, and utilising neurobiological evidence associated with approach- and avoidance-motivation (cf. Elliot & Covington, (...) 2001), this paper draws upon the Evaluative Space Model (ESM: Cacioppo et al., 1997) and considers the implications for understanding challenge and threat in sport. For example, rather than see challenge and threat as opposite ends of a single bipolar continuum, the ESM implies that individuals could be (1) challenged, (2) threatened, (3) challenged and threatened, or (4) neither challenged or threatened by a particular stimulus. From this perspective it could be argued that the appraisal of some sport situations as both challenging and threatening could be advantageous, whereas the current literature seems to imply that the appraisal of stress as a threat is maladaptive for performance. In drawing upon the ESM, we outline the Evaluative Space Approach to Challenge and Threat and provide several testable hypotheses for advancing understanding of challenge and threat (in sport). We also outline a number of cardiovascular and experiential measures that can be used to examine these hypotheses. Although connectionism is advocated by its proponents as an alternative to the classical computational theory of mind, doubts persist about its _computational_ credentials. Our aim is to dispel these doubts by explaining how connectionist networks compute. We first develop a generic account of computation—no easy task, because computation, like almost every other foundational concept in cognitive science, has resisted canonical definition. We opt for a characterisation that does justice to the explanatory role of computation in cognitive science. Next we examine (...) what might be regarded as the “conventional” account of connectionist computation. We show why this account is inadequate and hence fosters the suspicion that connectionist networks aren’t genuinely computational. Lastly, we turn to the principal task of the paper: the development of a more robust portrait of connectionist computation. The basis of this portrait is an explanation of the representational capacities of connection weights, supported by an analysis of the weight configurations of a series of simulated neural networks. My aim in this paper is to articulate further what may be called an agency theory of self-knowledge. Many theorists have stressed how important agency is to self- knowledge, and much work has been done drawing connections between the two notions.² However, it has not always been clear what _epistemic_ advantage agency gives us in this area and why it does so. I take it as a constraint on an adequate account of how a subject knows her own mental states (...) and acts, that it construe the known mental states and acts realistically and as independent of their self-ascription, and that it deliver genuine epistemic standing to the knower. The main task of the paper will, then, be to explore how our having rational agency with respect to our mental states may be able to secure genuine epistemic warrant for our self-ascriptions of states or acts independent of the ascriptions. This task will be carried out by focussing on the question of what account we should give of our knowledge of what I call our acts of judging. In the remainder of this section, I will do a little to clarify what is meant by that question. Section 2 will attempt to introduce us to elements of the best way to approach the question by considering some alternative strategies. Section 3 is devoted to forming some idea of what _kind_ of warrant we are looking for when considering how agency might give us self-knowledge. Section 4 aims to present a suggestion as to how agency gives us the kind of warrant identified over our acts of judging. Section 5 deals with some objections. (shrink)

Proponents of ecological restoration view the practice as a means of both repairing damage done to ecosystems by humans and creating an avenue to re-establish respectful and cooperative human-environment relationships. One debate affecting ecological restoration focuses on the place of 'exotic' species in restored ecosystems. Though popular, campaigns against exotics have been criticized for their troubling rhetorical parallels with nativism aimed at human immigrants. I point to some of the reasons why this critique of nativism persists, despite protests that no (...) xenophobic intent is evident, emphasizing the intimacy between social metaphors and claims about exotic nature. Language is but one facet of an entanglement of nature and society that ecological restoration strives to take seriously; however, restoration practice remains ambivalent toward this dichotomy permitting a longing for lost community purity that is embraced in nativism. Regarding defenses of nativism, I point out limitations of attempts to reframe the issue from a reactionary rejection of the foreign Other toward an argument for protecting communities from a process akin to 'cultural imperialism'. Reformers urge that representation no longer earns its explanatory keep in cognitive science, and that it is time to discard this troublesome concept. In contrast, we hold that without representation cognitive science is utterly bereft of tools for explaining natural intelligence. In order to defend the latter position, we focus on the explanatory role of representation in computation. We examine how the methods of digital and analog computation are used to model a relatively simple target system, and show that representation (...) plays an in-eliminable explanatory role in both cases. We conclude that, to the extent that biologic systems engage in computation, representation is destined to play an explanatory role in cognitive science. (shrink)
